1. Definitions
- “Levia”: HR management SaaS published by Levia SAS, Tunis.
- “Service”: all features available on https://leviahr.com, including the public API.
- “Client”: legal entity subscribing to a paid plan.
- “User”: natural person with an account (employee, manager, HR admin of the Client).
- “Plan”: subscription tier (Essential, Pro, Corporate).
2. Acceptance of terms
Using the Service implies full acceptance of these terms. By creating an account, the Client (via their legal representative) accepts these terms. Terms may be modified with 30 days' notice by email.
3. Description of Service
Levia is a cloud HRIS (Human Resources Information System) including:
- Leave and absence management
- Time and attendance tracking
- Multi-country payroll (TN, DZ, MA, LY, MU, FR)
- Performance and reviews (OKR)
- Recruitment and ATS
- Training and skills
- Conversational AI assistant (depending on plan)
- Public API (depending on plan)

4. Free trial
Paid plans are offered with a 30-day free trial, no credit card required. After this period, the account switches to read-only if no payment method is added. Data is retained for 90 days then purged unless the Client signs a new subscription.
5. Pricing and billing
Prices are communicated via personalized quote after a discussion with our sales team. A discount applies for annual billing.
VAT is added based on the billing country (19% Tunisia, 20% France, 19% Algeria, 20% Morocco). For EU companies with a valid intra-EU VAT number, reverse charge applies.
Billing is monthly or annual at the Client's choice. Payment is made by credit card via Stripe (PCI-DSS Level 1) or by bank transfer (on request for the Corporate plan).
6. Service Level Agreement (SLA)
- Essential / Pro plans: best effort, no contractual commitment.
- Corporate: 99.9% SLA monthly uptime (excluding planned maintenance windows). In case of non-compliance, prorata credit on the next invoice (5% per 0.1% bracket below threshold).
Planned maintenance is announced at least 48 hours in advance by email and performed outside CET business hours (weekends or nights).
7. Intellectual property
Levia retains exclusive intellectual property of the Service (code, design, brand, documentation). No license is granted to the Client beyond the right to use the Service.
The Client remains owner of the data they import or create in Levia. Levia commits to returning it at any time in CSV or JSON format.
8. Client obligations
The Client commits to:
- Provide accurate information at registration
- Protect their users' credentials (password, MFA)
- Comply with GDPR and local laws for data processed via Levia
- Obtain explicit consent from employees before any biometric enrollment
- Not use the Service for illegal, discriminatory or harmful purposes
- Not attempt to extract, copy or reverse-engineer the Service
- Pay invoices on time (30 days end of month)
9. Levia obligations
Levia commits to:
- Provide the Service in accordance with documentation
- Secure data (encryption, audit log, MFA)
- Comply with GDPR as a processor (Art. 28)
- Back up Client data daily
- Notify any data breach within 72 hours (Art. 33 GDPR)
- Return Client data at any time, on request
10. Termination
The Client may terminate at any time without commitment and without penalty from /admin/billing. Termination takes effect at the end of the current billing cycle (monthly or annual). No prorata refund is issued for started months.
Levia may terminate a Client's account with 30 days' notice in case of non-payment (15 days after unsuccessful formal notice) or serious breach of these terms.
After termination, data is retained for 90 days to allow recovery, then permanently deleted (except legal obligations).
11. Limitation of liability
Levia's liability is limited to the amount of the last 12 months of Client billing. Levia shall not be held liable for indirect damages (loss of revenue, loss of clientele, reputation damage).
The Service is provided “as is”. Levia does not guarantee that the Service will be bug-free or available 100% of the time, except Corporate SLA (§6).
12. Confidentiality
Each party commits to preserving the confidentiality of information exchanged within the Service. This obligation continues for 3 years after contract termination.
13. Force majeure
No party shall be held liable for a breach of these terms resulting from force majeure (natural disaster, war, pandemic, major outage of a third-party subcontractor such as AWS or Cloudflare, etc.).
14. Applicable law and jurisdiction
These terms are governed by Tunisian law. Any dispute shall be subject to the exclusive jurisdiction of the Tunis courts.
For clients located in the European Union, mandatory GDPR provisions and applicable local law prevail in case of conflict with these terms.
